Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2087

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A challenge on grounds of absolute simulation which the court is required to examine. Must be explicit in its meaning. Merely challenging on grounds of collusion or fraud. Does not signify this. - A registered contract takes precedence over an unregistered contract even if collusion between its parties to deprive the first purchaser is established. The second purchaser who registered his contract having knowledge of the prior sale. Does not, in itself, constitute a presumption of simulation of the subsequent sale.
