Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2143

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The invalidity of the agreement in a sale with a right of redemption attaches to the contract from its inception merely by the seller reserving his right to recover the sold property in return for refunding the price to the purchaser. The invalidity of the sale is not removed so that it becomes valid by failure to refund it, however much time elapses, if one or both contracting parties breach their contractual obligations. Registration of that contract does not alter this. The reason therefor.
