Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2151

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The legislature surrounded expropriation procedures with sufficient safeguards serving the public interest and preserving the rights of the owners of properties subject to those procedures. Property valuation takes place only after the expropriation decision has been issued and published in the Official Gazette and the Real Estate Registration Department has been notified by a copy thereof. Completion of these procedures removes the property from the sphere of transactions, and it is considered State public property; the real rights over the property transfer to the corresponding compensation amount. Article 33 of Law 33 of 1994. Example.
