Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2330

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Giving effect to the suspensive effect of the criminal judgment has no place if circumstances arise rendering it inappropriate to proceed with hearing the criminal action. The civil judge must proceed with hearing and deciding the civil action if these circumstances persist for an indefinite period or are not expected to cease. An example of the exceptional circumstances experienced by the country because of the Iraqi invasion thereof, which made it impossible to continue hearing criminal actions that had not been decided before the invasion.
