Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 240

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Legal rules depend, in their existence and non-existence, on their underlying cause. Where a provision is general and unqualified, there is no scope for narrowing or restricting it by reference to its rationale. - The obligation of a scholarship recipient or a person granted study leave to serve the State or one of the institutions in which it participates for a period equivalent to the period spent on the scholarship or study leave. Its implication is that the phrase “institutions in which the State participates” is general and unqualified, encompassing all forms of participation without any limitation. An example of a judgment’s error in interpreting the provision.
