English translation of the principle
Guarantee. Its condition. The existence of a guaranteed obligation owed by the principal debtor and the existence of a contract between the guarantor and the creditor creating an obligation owed by the debtor to perform the principal obligation that the debtor has not performed. The consequence thereof. The guarantor’s obligation is accessory to the principal obligation; thus, if the latter is void, that nullity extends to the guarantor’s obligation.

الكفالة. شرطها. وجود التزام مكفول في ذمة المدين الأصلي ووجود عقد بين الكفيل والدائن يرتب التزاماً في ذمة المدين بتنفيذ الالتزام الأصلي الذي لم ينفذه المدين. مؤدى ذلك. أن التزام الكفيل هو التزام تابع للالتزام الأصلي فإذا بطل الأخير فإن هذا البطلان يشمل التزام الكفيل.Original Arabic judgment citations
