English translation of the principle

Conclusion of a valid marriage. Its condition. Offer by the wife's guardian and acceptance by the husband or those acting in their stead. - The statutory text being unqualified in specifying who has guardianship to conclude the marriage contract of a virgin between puberty and completion of the twenty-fifth year, or a previously married woman who has reached the twenty-fifth year. Its implication. No scope for restricting it. Construing it as - 65 - Law specifying guardians for marrying a virgin between puberty and the twenty-fifth year. Incorrect. The rationale: the legislature's intention was not directed to that. - The legislature's intention being directed to identifying the guardian. Its import. This must be expressly stipulated in a particular place in the law. Articles 8, 29 and 30 of Law 51/1984 concerning Personal Status.
