Kuwait Court of Cassation principle number 3066
State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The nullity of a contract concluded by a non-Kuwaiti for violating the prohibition contained in the Commercial Code or any other legislation. Its implication is the restoration of everything to its original state and the recovery by each contracting party of what that party gave, if feasible. If this is impossible, the judge may require that party to render equivalent performance in the amount of the benefit accruing to that party or the loss sustained by the impoverished party. The basis thereof. Example.
