Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3068

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The nullity of a contract concluded by a non-Kuwaiti in contravention of the prohibition contained in the Commercial Code or any other legislation prohibiting non-Kuwaitis from engaging in trade in Kuwait requires restoration of everything to its original state and recovery by each contracting party of what he gave, if feasible. If this is impossible for one contracting party, the judge may require him to render an equivalent performance. - The principle of enrichment requires the enriched party to return the value of the enrichment at the time it occurred or of the impoverishment at the time judgment is rendered.
