Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3092

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The possibility of performing the obligation is one of the conditions that must be satisfied by its subject matter. The reason therefor. There is no obligation to perform the impossible; otherwise, the contract is void. - A void contract produces no effect from the time of its conclusion, and this entails treating its performance as though it had never occurred, if it has been performed, and restoring the contracting parties to the position they occupied at the time of the contract, if that is feasible.
