Kuwait Court of Cassation principle number 3113

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity or annulment of the contract. Its effect: extinguishing the contract from the time of its conclusion, treating its performance—if any—as though it had not occurred, and restoring the contracting parties to the position they were in at the time of contracting. Requiring one party to the contract to compensate the other in the amount of the benefit accruing to the enriched party and the loss suffered by the impoverished party. This is subject to the assessment of the court of merits.
