Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3212

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity of a contract concluded by a non-Kuwaiti in violation of the prohibition contained in the Commercial Code or any other legislation preventing that person from engaging in commerce in Kuwait. Its implication. Restoring everything to its original state and each contracting party recovering what it gave, if feasible. Impossibility of this for one contracting party. It may be required to provide equivalent performance to the other contracting party. This is determined by the benefit accruing to it or the loss sustained by the impoverished party, whichever value is less, pursuant to the rule prohibiting enrichment without cause as a direct source of obligation. Example.
