Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3246

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Receipt of what is not due. Sufficient to impose upon the recipient an obligation of restitution, on the ground that he is unjustly enriched at another's expense; what matters is what he received. In determining that something is not due, the perspective is that of the recipient, not the payer. It is thereafter immaterial whether the lack of entitlement arises from the factual situation itself, such as the recipient collecting a debt not owed to him or more than he is entitled to, or arises from a legal consideration. - An action to recover what was paid without right. It lapses upon the passage of three years from the day on which the claimant knows in recovery, or upon the lapse of fifteen years from the day on which this right arises, whichever period is earlier. Contravention thereof. An error requiring cassation of the judgment.
