Kuwait Court of Cassation principle number 3316

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The constitutional principle is freedom of thought and expression of opinion, including the right to criticize. The exception: prohibition of publication if it would prejudice one of the stipulated values. Publication aimed at raising a public issue and criticizing the position of an entity in pursuit of the public interest. Fault giving rise to liability is absent from it, even if its wording is severe and its commentary vehement.
