Kuwait Court of Cassation principle number 3551

The administration's liability alongside the employee to the injured person on the basis of a superior's liability for the acts of his subordinate. It may not have recourse against that employee for what it was ordered to pay unless the fault committed by him was personal fault and not service-related fault. Fault may not be considered personal unless it is gross or the employee was driven by personal factors intended to cause harm or secure a personal benefit for himself or another. Contravention thereof. Vitiates the judgment and requires its cassation.
