Kuwait Court of Cassation principle number 3569

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The liability of the custodian of a thing rests on presumed fault. It does not admit proof to the contrary. However, it is removed if the custodian proves that the damage occurred through an extraneous cause. This can only be force majeure, a fortuitous event, the act of the injured party, or the act of a third party. The third party's act must be unforeseeable and unavoidable. - Inferring the causal relationship between the act of the thing and the damage. Within the authority of the court of merits. Provided that it is reasonable. Example of an unreasonable inference negating the causal relationship.
