Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 371

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The imposition by a civil court, in an administrative dispute, of the sanction of deeming an action never to have been brought for failure to serve it pursuant to Article 49 of the Code of Procedure does not render its judgment defective for an error in the application of the law. Reason: the Code of Procedure is the general procedural law. It applies where no provision is made in other laws.
