Kuwait Court of Cassation principle number 4
State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
Invoking custom. Impermissible unless legislation contains no provision applicable to the issue presented. The absence of special legislation regulating the issue does not justify recourse to custom as a subsidiary source so long as existing legislation contains a provision providing a solution to the issue.
Arabic original
Original Arabic judgment citations
