English translation of the principle

Definition of mental infirmity under Article 945 of the provisions of the Majalla of Judicial Rules and the statements of jurists. Assessment of the existence of mental infirmity. A matter of fact. The disposition of a mentally infirm person is like that of a discerning minor; permission is not granted by anyone other than the guardian. The Majalla does not require mental infirmity to have been commonly known before registration of the interdiction order or known to the other contracting party.
