Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 634

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Dispositions capable of both benefit and detriment. What is meant by them. An example. - A person with diminished capacity invoking his diminished capacity. His having claimed to possess capacity does not prevent this. - A minor's resort, in order to conceal his capacity, to fraudulent methods capable of concealing his diminished capacity. His obligation to compensate the person who contracted with him for the harm resulting from avoidance of the contract. The distinction between a minor and a person with diminished capacity in this respect: the stratagem used by a minor to conceal his age may deceive an ordinary person, whereas, in the case of persons with diminished capacity other than minors, such as prodigals and persons susceptible to deception, it is difficult for it to deceive an ordinary person.
