Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 92

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that a new law does not apply to the past. It applies to legal positions formed after its entry into force, whether in their creation, production of effects or extinction, and to the future effects of previous legal positions. Excepted from this are the effects of legal transactions concluded under the old law, unless the provisions of the new law relate to public policy, in which case they apply to those effects arising after its entry into force.
