A suspensive condition. That upon whose fulfilment the existence of the obligation depends. - A suspensive condition dependent upon the will of one of the parties to the obligation. A valid condition. The reason. - The existence of the obligation during the period of its suspension is uncertain. The effect thereof. The creditor is prohibited from taking enforcement measures to compel satisfaction of his right so long as the condition has not been fulfilled.

الشرط الواقف. ما يتوقف وجود الالتزام على تحققه. - الشرط الواقف المعلق على إرادة أحد طرفي الالتزام. شرط صحيح. علة ذلك. - وجود الالتزام أثناء فترة تعليقه يكون وجوداً غير مؤكد. أثر ذلك. حظر اتخاذ الدائن لوسائل التنفيذ لاقتضاء حقه جبراً طالماً لم يتحقق الشرط.Original Arabic judgment citations
