An action for liability for an unlawful act arising from a crime. It is not time-barred unless the criminal action is time-barred. The injured party’s choice of the civil rather than the criminal route to claim compensation for damage arising from the crime. Its effect. Suspension of the running of prescription so long as the right to institute, initiate or proceed with the criminal action remains in existence. Extinction of the criminal action by a final judgment of conviction or another ground of extinction. Its effect. Resumption of the running of prescription from the date of that extinction.
