Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 12

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The parties' agreement that the contract's term is 1 year and is automatically renewed for another similar term or terms unless either party notifies the other, 1 month before expiry of the original or renewed term, of his wish not to renew. It is regarded from its inception as a contract of indefinite duration. The reason therefor. Failure to specify the future event by which the contract ends in a manner eliminating uncertainty, because its parties omitted to specify the number of renewals. Its implication. The respondent is not entitled to seek compensation for the appellant company's termination of the contract concluded between them. The basis therefor. The challenged judgment's departure from this view, treating that contract as a fixed-term employment contract and consequently holding the respondent entitled to compensation for the remainder of the contract term. Faulty reasoning leading to an error in the application of the law, requiring its cassation. Compensation for an unlawful act "tort liability":
