A creditor may assign to another his right against his debtor unless this is prohibited by a provision of law, an agreement between the contracting parties, or the nature of the obligation. - The transfer of the main contractor's right against the employer to the assignee takes place encumbered by the statutory privilege granted to the subcontractor whenever that assignment occurred on a date subsequent to the conclusion of the subcontract.
