State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Entitlement to interest for delay in payment of commercial debts as soon as they fall due. Its condition. Their subject matter must be a sum of money of a known amount at the time it arises. If it is not so. Interest runs from the date of the final judgment. - What is meant by the subject matter of the obligation being of a known amount when the obligation arises is that determination of its amount rests on fixed bases in respect of which the judiciary has no discretion to assess. The debtor’s dispute over its amount does not affect this. The rationale for this. The challenged judgment’s departure from this view and its affirmation of the first-instance judgment awarding the appellant statutory interest from the date the judgment becomes final. An error requiring its cassation.
