Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1719

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The contract of carriage imposes upon the carrier the obligation to deliver the goods sound and complete, in the described condition in which they were handed over to it, at the port of arrival. If they sustain damage, the carrier is required to compensate for it unless it furnishes evidence negating this liability. No fault attaches to the court of fact if it refuses to appoint an expert to assess compensation. Example.
