English translation of the principle
Novation of an obligation. Its condition. Both the old and the new obligations must be free from grounds of nullity. Reason therefor. The old obligation's being void entails the nullity of the new obligation for absence of its cause, so no novation occurs; nullity of the new obligation leaves the old obligation subsisting.

تجديد الالتزام . شرطه . خلو الالتزامين القديم والجديد من أسباب البطلان . علة ذلك . كون الالتزام القديم باطلاً يستتبع بطلان الالتزام الجديد لتخلف سببه فلا يقع التجديد، بطلان الالتزام الجديد يبقى الالتزام القديم قائماً.Original Arabic judgment citations
