State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Army conscripts employed by State ministries and departments. During their conscription, they are regarded as army personnel whose affairs are governed by laws and decisions concerning the army, not by the Civil Service Decree. This is not altered by their employing entities' obligation to bear the salaries, increments and allowances they receive and transfer them to the Ministry of Defence. Absence from the Army Law and the Compulsory and Reserve Service Decree of special rules governing prescription of amounts they receive without entitlement. Their invocation of the prescription stipulated in the Civil Service Decree. Has no basis. The challenged judgment's contravention thereof and its application of this prescription. Contravention of the law requiring cassation.
