Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 268

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The nullity of a contract concluded by a non-Kuwaiti for contravening the prohibition contained in the Commercial Code or any other legislation prohibiting a non-Kuwaiti from engaging in trade in Kuwait requires restoring everything to its original state and each contracting party recovering what he gave, if that is feasible. If this is impossible for either contracting party, the judge may require him to render equivalent performance. - 61 - Obligation - The principle of enrichment requires the enriched party to repay the two values of enrichment at the time it occurred or impoverishment at the time judgment is delivered.
