Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2944

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Sale of property belonging to another. Concluded subject to ratification by the true owner. If the owner ratifies it, it becomes effective; if the owner does not ratify it, it becomes nonexistent. - If the sold property is in the purchaser's possession and the true owner does not ratify the sale, the purchaser must return the sold property. If return becomes impossible through the purchaser's fault, the seller's recourse against the purchaser is governed by the rules of tort liability and not based on the contract that has become nonexistent.
