A sale (C and F) is a sale upon shipment to which the rules of a CIF sale, cif, apply, except for the seller's obligation to insure the goods during the sea voyage for the purchaser's benefit. The seller thus bears the risk of any damage that may befall the goods during performance of the sea carriage until he crosses the ship's rail, from the transfer of ownership of the goods to the purchaser, and the seller has no concern with their fate. The contract's inclusion of a condition altering its nature and the essence of its provisions. Its effect. The description (C and F) conferred upon it by the contracting parties does not apply to it, and that description has no meaning other than being merely a method of determining the components of the price. البيع (سي آند إف) هو بيع عند الشحن تطبق عليه قواعد البيع سيف cif عدا التزام البائع بالتأمين على البضاعة أثناء الرحلة البحرية لصالحة المشتري فيتحمل البائع تبعة ما قد يلحق بالبضاعة من ضرر أثناء تنفيذ النقل البحري حتى يجتاز حاجز السفينة منذ نقل ملكية البضاعة إلى المشتري ولا شأن للبائع بمصيرها. تضمن العقد شرطاً يغير من طبيعته وجوهر أحكامه. أثره. لا يصدق عليه ما خلعه عليه العاقدان من وصف (سي آند إف) ولا يكون لهذا الوصف معنى سوى أنه مجرد طريقة لتحديد عناصر الثمن. بيع المال الشائع:Original Arabic judgment citations
