Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3108

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Where a statutory provision is clear and explicit, there is no scope for seeking guidance from the rationale of the legislation. That is appropriate where it is ambiguous. Where the legislative provisions governing the substantive rules on gifts in the Civil Code are clear, there is no scope for referring to their source in Islamic Sharia.
