Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3213

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Management of jointly owned property belongs to the manager whose appointment is agreed upon by those owning the majority of the shares. Their failure to appoint a manager and one co-owner's independently undertaking one of those acts. The effect thereof: that co-owner is deemed, in what was done, to represent all of them. The condition for this: the majority must not object within an appropriate time. - One undivided co-owner's bringing an action to vacate and deliver the premises. Falls within management of jointly owned property and suffices to establish standing to bring it. The judgment's departure from this. An error in the application of the law requiring its cassation.
