A lease granted by one co-owner in undivided ownership. Its effects extend directly to the remaining co-owners. Basis thereof: statutory representation. Its condition. No objection by the majority of the co-owners in due time. Effect thereof. The lessor and the remaining co-owners are obliged not to interfere with the lessee's enjoyment of the entire property. The lessee may have recourse against the interfering party for the full warranty. Basis thereof. The lessor's warranty obligation is indivisible.

الإيجار الصادر من أحد الشركاء على الشيوع. إنصراف آثاره مباشرةً إلى باقي الشركاء. أساس ذلك: النيابة القانونية. شرطه. عدم اعتراض أغلبية الشركاء في الوقت المناسب، أثر ذلك. التزام المؤجر وباقي الشركاء بعدم التعرض للمستأجر في كل العين. للمستأجر الرجوع على المتعرض بالضمان كاملا.ً أساس ذلك. التزام المؤجر بالضمان لا يقبل الانقسام.Original Arabic judgment citations
