English translation of the principle
A lease contract containing substantial conditions unusual in an ordinary lease. Its exclusion from the scope of application of the provisions of Law 35/1978 concerning Real Estate Leases. Reason therefor: these conditions constitute a legal presumption that its parties intended to create a contract different from a lease.

عقد الإيجار المشتمل على شروط جوهرية غير مألوفة في الإيجار العادي. خروجه عن نطاق تطبيق أحكام القانون ٣٥/١٩٧٨ في شأن إيجار العقارات. علة ذلك: هذه الشروط قرينة قانونية على انصراف نية طرفيه إلى إنشاء عقد يغاير الإيجار.Original Arabic judgment citations
