Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3446

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An appeal transfers the action to the Court of Appeal with its factual elements and legal evidence, solely within the limits of what has been appealed. A new ground may be added while the original claim remains unchanged. An example concerning the nullity of a lease of shops concluded by a non-Kuwaiti, which does not preclude basing his appeal on unjust enrichment as a new ground for the claim for equivalent payment. - 679 - Lease
