Kuwait Court of Cassation principle number 3619

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Subsequent ratification is equivalent to prior authorization. - Ratification may be express or implied. The mere silence of the principal in not invoking the ineffectiveness of the disposition despite knowledge of it does not constitute approval thereof, however long the period, unless an intention to ratify the disposition is understood from its circumstances. - Assessing whether subsequent approval of the disposition by the principal has occurred. A matter of fact independently assessed by the trial judge, provided the assessment is reasonable.
