Kuwait Court of Cassation principle number 3940

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The surety’s failure to notify the debtor of his intention to pay before payment occurs does not extinguish his right of recourse against the debtor for what he paid to the creditor, unless the debtor proves that he had paid the debt or had grounds leading to its extinction or invalidity.
