Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3941

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Guarantee of a future obligation. Its effect. Restriction of the guarantee to its specified term. The guarantee contract must include the maximum amount for which the guarantor is liable. The guarantor’s failure to specify a duration for his guarantee. Its effect. The guarantor may revoke it at any time so long as the guaranteed obligation has not yet arisen. The condition for this: notifying the creditor at an appropriate time. A guarantee is a gratuitous contract. It must be construed narrowly. Doubt concerning it is construed in the guarantor’s favor. An example of a defective interpretation.
