English translation of the principle

Abandonment requiring that an action not be heard under Sharia. Its nature. It is abandonment of the property while grounds for an action exist through another’s usurpation of the property, encroachment upon it, and denial of its owner’s right. Mere abandonment and neglect of the property and failure to exercise any right over it, however long the time, without anyone interfering with or usurping it. Does not extinguish its ownership by the waqf entity entitled to it until a possessor takes possession and fulfills the legal requirements for possession.
