Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4151

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The purchaser, as the seller's particular successor, may tack his predecessor's possession onto his own possession to acquire ownership by prescription. He may rely on an unregistered purchase contract as evidence of the transfer of possession of the property to him and of its being an extension of the possession of his predecessor, the seller.
