Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4199

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An action for compensation for preventing the possessor of immovable property from possessing it. The defendant therein is anyone who commits a positive act upon the property leading to that prevention. It suffices that the possessor's possession is current physical possession, with his control actually connected to the property and existing at the time of prevention, placing the person preventing possession in the position of one taking the law into his own hands without resorting to the courts. An example of the defendant being the proper party for changing the key to a chalet with the intention of preventing its possession.
