State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Liability for personal injury. Its financial burden falls upon the direct actor. - The direct actor and the indirect causer. Their definitions under Islamic jurisprudence. - The direct actor. A person whose act, personally performed, itself brought about the damage. - The indirect causer: a person who was a cause of the matter but did not himself bring it about. An example concerning the absence of the status of direct actor: damage arising directly from the victim's collision with the left side of a stationary vehicle, without intervention by another, negates its driver's status as direct actor.
