Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4428

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Property that becomes public property merely by being dedicated to public benefit is the property of the State and public legal persons, not the property of individuals. - Individuals’ property does not become public property unless the State acquires ownership of it and then dedicates it to public benefit. An example. - When a road is dedicated to public benefit. Its being considered as such. A question of fact. - Use of privately owned land as a thoroughfare. Is not sufficient to consider it dedicated to public benefit. What is required for it to be so considered: continued use as a thoroughfare for the period necessary to acquire ownership by long prescription.
