Kuwait Court of Cassation principle number 464

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Sharia-prescribed diya constitutes compensation only for the bodily injury itself. Consequently: awarding compensation in this case does not constitute an award of compensation for a single element of damage. - The element of cause in gratuitous dispositions, whether made by contract or unilateral will. Its nature. A donative intention on the part of the injured party towards the insurance company is inconceivable. Its absence makes the release a disposition devoid of its cause, rendering it absolutely void. The effect thereof. Example.
