Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 57

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The heirs' claim for compensation for the death of their predecessor as a result of a harmful act. It is inconceivable in fact or law before death occurs, since death is the basis of entitlement thereto. Consequently: the predecessor's declaration waiving his right to compensation has no effect on the heirs' entitlement to it. The reason therefor: death itself is the event giving rise to this right, in addition to the heirs' right to compensation for the direct personal damage they sustained.
