Anything in the judgment beyond that exceeds the scope of the action and its requirements and has no res judicata effect. دعوى التعويض المؤقت. أساسها. مجردّ ثبوت المسئولية وثبوت الضرر دون عناصر ومداه وإرساء التعويض دون مقداره. ما يجاوز به الحكم ذلك خروج عن نطاق الدعوى ويزيد عن حاجتها ولأ تكون له حجية. مخالفة الحكم ذلك وخلع الحجية على هذا الزائد. خطأ يوجب تمييزه. مثال.Original Arabic judgment citations
