Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 648

State of Kuwait · Civil Matters — Volume 11 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The impermissibility of combining two compensations for a single injury. Its implication. The impermissibility of combining diya and inherited compensation. The reason therefor. The unity of the subject matter of both claims, namely compensation for personal injury. The challenged judgment's departure from this view and its finding that the court of first instance omitted to adjudicate the claim for inherited compensation. An error in applying the law. This finding of error, even if correct, would achieve only a purely theoretical interest that is disregarded, because adjudication of the claim after cassation of the judgment would inevitably result in its dismissal owing to the impermissibility of combining this claim and diya. - 131 - Obligation Compensation for fault directed against the deceased:
