Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1008

State of Kuwait · Pleadings — Part One · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Clerical errors in a judgment. Their correction is not exclusively reserved to the court that issued it; the Court of Appeal shares that power as an ancillary jurisdiction vested in it by virtue of an appeal brought before it and pending before it, and pursuant to the rule that an appeal transfers the action to the Court of Appeal with its factual elements and legal evidence. That court may therefore, of its own motion or at the litigants’ request, correct any purely clerical or arithmetical errors that may have occurred in the appealed judgment. An example. 21- The court competent to examine a plea of invalidity of the contract in which arbitration was agreed:-
